UKGC affiliate compliance: a monitoring SOP you can run
The standing procedure a Great Britain licensed operator needs so affiliate advertising is a controlled third-party programme rather than an occasional manual review.
Why this document has to exist
Under LCCP 1.1.2 the licensee is responsible for marketing carried out on its behalf, and the CAP Code applies to affiliate content. "The affiliate published it without our approval" is not a defence, and the ASA has said so directly. In practice a regulator will ask what your monitoring programme is. This is that programme, written down.
1. Scope and ownership
This procedure covers every affiliate, sub-affiliate, influencer and media partner promoting the licensee's Great Britain facing brands, across every channel they use, not only the domains they declared at signup.
- Accountable: the nominated Personal Management Licence holder for marketing.
- Responsible: affiliate manager for remediation, compliance for classification and sign-off.
- Out of scope: the operator's own owned channels, covered by the marketing approval process. In scope the moment an affiliate reproduces that material.
The governing test throughout: monitor what a consumer in Great Britain can actually see, not what the affiliate agreement says they should be publishing.
2. Maintain a live affiliate inventory
Nothing downstream works without this. A monitoring programme that only covers declared URLs will miss the pages a regulator finds first.
| Field | Why it is on the register |
|---|---|
| Affiliate legal entity and contact | A named person who can be served a remediation request, not a support inbox |
| Tracking IDs | The only reliable way to attribute a discovered page back to a responsible partner |
| All domains and subdomains | Including ones discovered later. New domains get added, never quietly ignored |
| Social and video accounts | X, Instagram, TikTok, YouTube, Telegram. CAP applies to these equally |
| Sub-affiliate relationships | Where a partner runs their own network, the downstream publishers are still your exposure |
| Markets targeted | A partner serving both GB and an unlicensed market needs different handling |
| Risk tier | Output of section 8. Drives scan frequency |
Discovery is part of maintenance. Search monthly for brand plus bonus, free spins, no deposit, promo code and review. Any affiliate page that appears and is not on the register is itself a finding, because it means an undeclared partner or an undeclared domain.
3. Scan cadence
| Trigger | Scope | Frequency |
|---|---|---|
| Standing scan, high-risk tier | All pages and social accounts for tier 1 partners | Weekly or continuous |
| Standing scan, full programme | Every registered domain, page and account | Monthly |
| Undeclared-page sweep | Open web search on brand plus offer terms | Monthly |
| Offer change | Every page carrying the changed offer | Within 48 hours of the change going live |
| Campaign and major event | Partners active on the campaign | Before launch and mid-campaign |
| New partner onboarding | Full first scan before the first payout | Once, then per tier |
4. The check set
Run every check on every scanned page. Record each as Pass, Fail or Unverified. Unverified is a legitimate result where the page could not be fully rendered, and it must never be recorded as a pass.
| Check | What fails | Reference | Sev |
|---|---|---|---|
| Licensed operators only | Any brand on the page without a GB remote operating licence | Gambling Act 2005 s.33 | P1 |
| Bonus terms placement | Wagering, restrictions or withdrawal limits behind a tooltip, an asterisk or a separate page | CAP 16, ASA rulings | P1 |
| Offer still current | A bonus, price or promotion the operator no longer runs | CAP 3.1 misleading | P1 |
| Risk-free language | "Free bet", "risk-free", "no risk" where conditions attach | CAP 16.3.5 | P1 |
| Appeal to under-18s and under-25s | Imagery, language, cartoon or gamified styling, youth-skewed talent | CAP 16.3.12 | P1 |
| Financial-solution framing | Gambling shown as income, a way to clear debt, or a route to status | CAP 16.3.1, 16.3.3 | P1 |
| Affiliate disclosure | Commercial content not marked as advertising before the reader engages | CAP Code, CMA guidance | P2 |
| Safer-gambling references | No GAMSTOP, no BeGambleAware, no helpline 0808 8020 133 | LCCP SR code 5 | P2 |
| Link destination | Affiliate link resolving to the wrong brand, an expired landing page, or an unlicensed mirror | LCCP 1.1.2 | P2 |
| Undisclosed sub-affiliate | Traffic arriving via a publisher not on the register | LCCP 1.1.2 | P2 |
| Superlatives without basis | "Best", "top rated", "number one" with no disclosed methodology | CAP 3.7 substantiation | P3 |
| Stale ranking or review date | Content presented as current but last updated long ago | CAP 3.1 | P3 |
Two checks cannot be done from HTML alone and must be run as a consumer journey: follow the affiliate link and record the landing page, the offer actually presented, any geo routing, and the terms shown at registration. A discrepancy between the affiliate's advertised offer and the operator's real one is a P1 finding regardless of who introduced it.
5. Severity and response times
| Level | Definition | Immediate action | Remediation SLA |
|---|---|---|---|
| P1 | Clear breach, regulator-prioritised, or consumer harm | Suspend the link or the partner's tracking pending fix | 24 hours |
| P2 | Likely breach, context dependent | Written correction request | 72 hours |
| P3 | Best-practice deviation | Logged, batched into the monthly partner review | 30 days |
Repeat findings escalate one level. A second P2 of the same type from the same partner within 90 days is treated as P1.
6. Evidence pack per finding
Every finding needs a record that would still make sense to a regulator, or to the partner disputing it, six months later. Capture at the point of detection, because the page will change.
- finding_id, and detected_at with timestamp and timezone
- affiliate_id from the register, and the full url including parameters
- channel: web, social, video or email
- market_targeted, with the evidence for GB targeting
- check_failed and the reference clause, plus severity
- evidence_quote, verbatim, never paraphrased
- screenshot, full page, timestamped
- rendered_from, the geography the page was fetched from
- owner, due per SLA, status, and verified_at for the second check confirming the fix
Two fields carry more weight than people expect. Verbatim quote, because a paraphrase is arguable and a quote is not. Rendered from, because affiliate pages routinely serve different content by geography, and a finding is only meaningful if you can say which audience saw it.
7. The remediation workflow
- Detected. Finding created with the full evidence pack, severity assigned by compliance rather than by the affiliate team.
- Reviewed. Compliance confirms or dismisses within one working day. Dismissals are logged with a reason, since a pattern of dismissals is itself a signal.
- Notified. Correction request to the named contact, quoting the URL, the clause and the evidence, with the SLA stated.
- Corrected. Partner confirms the change.
- Verified. You re-check independently. A partner's confirmation is not a verification, and this step is the one most often skipped.
- Escalated. On a missed SLA: pause tracking, withhold commission on affected traffic, then terminate for serious or repeated breaches.
8. Risk tiering
You will not review every partner with equal intensity, and pretending otherwise produces a programme that quietly stops running. Score each partner, review the top tier weekly and the rest monthly.
| Factor | Higher-risk signal |
|---|---|
| Breach history | Any prior P1, or two or more P2s |
| GB traffic volume | Large share of your GB acquisition |
| Channel mix | Social, influencer or video rather than a static site |
| Audience | Any evidence of under-18 reach |
| Content type | Bonus and offer pages rather than editorial |
| Network structure | Runs sub-affiliates, or the traffic source is unclear |
| Transparency | Undisclosed relationship, or undeclared domains found |
| Responsiveness | Previously missed a remediation SLA |
| Update frequency | Publishes often, so drifts from approved copy faster |
9. Contractual controls this depends on
None of the enforcement steps above are available unless the affiliate agreement grants them. Confirm all of the following are present, and that they flow down to sub-affiliates.
- Pre-approval of promotional claims and creative for higher-risk partners
- Express prohibition on advertising unauthorised or expired offers
- Compliance with the CAP and BCAP Codes and LCCP as a contractual obligation
- Right to audit affiliate activity, including social and video channels
- Obligation to remove or amend non-compliant material within your stated SLA
- Right to suspend tracking and withhold commission on affected traffic
- Termination for serious or repeated breach
- Mandatory flow-down of all of the above to sub-affiliates
- Requirement to declare every domain and account used to promote the brand
10. The monthly compliance report
One page. The purpose is to show a regulator, and your own board, that the programme runs on a schedule and closes what it opens.
| Metric | Why it is on the report |
|---|---|
| Pages and accounts scanned | Coverage. Compare against the register to expose blind spots |
| Findings opened, by severity | Volume and mix |
| Findings closed and verified | Closed is not the same as verified. Report both |
| Median time to remediation | Against SLA, by severity |
| Open past SLA | The number that should be zero and rarely is |
| Repeat offenders | Partners with two or more findings in 90 days |
| Undeclared pages discovered | Measures whether the register is honest |
| Unverified checks | Where you could not see the page properly. A rising number means the monitoring is degrading |
| Enforcement actions taken | Suspensions, withheld commission, terminations |
Retain findings, evidence and the monthly reports for the period set by your record-keeping policy. The audit trail is the deliverable when a regulator asks what you were doing about affiliate advertising, and the answer needs to be a dated record rather than an assurance.
Where Kaspero fits
Sections 2, 3, 4 and 6 are the parts that stop being feasible by hand once a programme passes a few dozen partners across more than one market. Kaspero runs the scanning, captures the evidence pack including the geography a page was rendered from, and keeps the register honest by surfacing pages that promote you but are not on it.
The rules for the other nine markets we cover are in affiliate advertising rules in ten regulated markets.
